San Joaquin County District Attorney Files Past Assault Charge Against Rocky Overturf

An assault case from about a year ago has been reopened and charged against Rocky Overturf, 26, of Escalon, by the San Joaquin County District Attorney’s Office earlier this week. 

The past assault charge was added to Overturf’s already pending murder case in the death of 36-year old Aaron Messick. The year-old case has its similarities in the fact that both cases occurred behind the Valley Inn bar on Main Street in Escalon.

The San Joaquin District Attorney is attempting to establish a behavior pattern by adding this year-old case against Overturf. The similarities being both men were reportedly behind the Valley Inn when Overturf hit them and they both fell, hitting their heads on an object or the ground. The District Attorney’s Office and the Escalon Police Department want a plea deal for nothing less then the original murder charge or to take the case to trial.

The victim in the 2015 case, reportedly went home where he went into convulsions and his wife called 9-1-1. An ambulance did respond to his residence and the victim was treated for his injuries by emergency personnel. The Police Officers on scene did offer to make a report and file charges against Overturf, but the victim was reluctant to press any formal complaint against his assailant.

According to the San Joaquin County Sheriff Department’s website, Overturf remains in custody at the San Joaquin County Jail without bail on the murder charge of Aaron Messick and on the newly filed assault charge from 2015. Overturf has appeared once for arraignment at the Stockton Courthouse and is due back before the judge at 8:30 AM on Wednesday, December 14, 2016 in Department 35. The Department’s website also reflects the pending charges as PC 187(A) which is felony murder and PC 245(A)(1) a felony assault with a deadly weapon/automobile.
